These Terms of Service (“Terms”) are a legal agreement between you and Edvin Åslund, operating as Freqel (“Freqel,” “we,” “us”), governing your access to and use of app.freqel.com, freqel.com, and the associated service that lets you write a post once and publish it to multiple social media platforms (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use Freqel.
1. Eligibility
You must be at least 16 years old to use Freqel. If you use Freqel on behalf of a company or other organization, you confirm you have the authority to bind that organization to these Terms, and “you” refers to both you and that organization.
2. Your account
You’re responsible for maintaining the security of your account and everything that happens under it. Notify us immediately at hello@freqel.com if you suspect unauthorized access. Account authentication is handled by our provider, Clerk.
3. Connecting third-party platforms
Freqel lets you connect accounts on third-party platforms — including Bluesky, Instagram, Facebook, and Threads (operated by Meta), TikTok, and others we add over time — so you can publish content to them. When you connect a platform:
- You represent that you own that account, or have the account owner’s explicit permission to connect and publish through it.
- You remain solely responsible for the content you publish and for complying with that platform’s own terms of service, community guidelines, and advertising or content policies — for example Meta’s Platform Terms and TikTok’s Terms of Service.
- You authorize Freqel to access and use that account solely to publish the content you create and submit inside Freqel, as described in our Privacy Policy.
- You can revoke this access at any time by disconnecting the account in Freqel’s settings, or by removing Freqel’s access directly on the third-party platform.
Freqel is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., TikTok Inc./ByteDance, Bluesky Social PBC, or any other platform we integrate with. Their names and logos are their respective owners’ trademarks, used only to describe the integration.
Third-party platforms change their APIs, policies, and availability without notice, and can suspend or terminate your account on their platform independently of Freqel. We are not responsible for outages, feature changes, content removal, or account actions taken by a third-party platform.
4. Acceptable use
You agree not to use Freqel to:
- Post content that is illegal, fraudulent, hateful, harassing, defamatory, or that infringes someone else’s intellectual property or other rights.
- Impersonate any person or entity, or misrepresent your affiliation with one.
- Post spam, or content designed to manipulate a platform’s algorithms, engagement metrics, or advertising systems.
- Violate the terms, community guidelines, or acceptable-use policies of any platform you connect through Freqel.
- Resell, sublicense, or white-label Freqel as your own product.
- Reverse-engineer, scrape, or load-test our infrastructure, or attempt to bypass rate limits or access controls. Reasonable API use is welcome — contact us if you need more.
- Upload malware, or attempt to gain unauthorized access to Freqel or any connected account that isn’t yours.
We may suspend or terminate accounts that violate this section, with or without notice, at our discretion.
5. Your content
You retain all ownership rights to the content you create, draft, and publish through Freqel. By submitting content, you grant Freqel a limited, non-exclusive, worldwide license to host, process, and transmit that content solely to operate the Service — namely, to generate previews and publish it to the platforms you’ve connected and instructed us to publish to. We claim no ownership over your content, and we do not use it to train AI models or for any purpose beyond delivering the Service you asked for.
You’re solely responsible for having the rights to any content you post — including images, video, quotes, and trademarks — and for ensuring it complies with applicable law and the policies of the platforms you publish to.
6. Subscriptions and billing
- Freqel offers a Free plan and a paid Pro plan, described on our pricing page. Features and limits may change; we’ll give notice of material changes to paid plans.
- Paid subscriptions are billed in advance on a recurring basis through Stripe and renew automatically until canceled.
- You can cancel anytime from Settings → Billing; cancellation takes effect at the end of your current billing period, and you keep access until then.
- Except where required by law, payments are non-refundable. If you believe you were charged in error, contact hello@freqel.com.
7. Intellectual property
Freqel, its logo, design, and underlying software are owned by us and protected by intellectual property law. These Terms don’t grant you any right to use our branding except as needed to use the Service normally.
8. Termination
You may stop using Freqel and delete your account at any time by emailing hello@freqel.com. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service — where practical, we’ll give advance notice. On termination, your right to use the Service ends immediately; §§5, 9, 10, and 11 survive termination.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee that the Service will be uninterrupted, error-free, or that any third-party platform will remain available, unchanged, or compatible with Freqel.
10. Limitation of liability
To the maximum extent permitted by law, Freqel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold Freqel harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your content, your use of the Service, your connected accounts, or your violation of these Terms or applicable law.
12. Changes to these terms
We may update these Terms as Freqel evolves. We’ll post the updated Terms here and update the “Last updated” date; for material changes, we’ll also notify active subscribers by email. Continuing to use Freqel after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles, except where mandatory consumer protection law in your country of residence requires otherwise. We’ll try to resolve any dispute informally by email first — contact hello@freqel.com.
